Conditions de vente

These terms and conditions are entered into between Tragopan, a limited liability company with a capital of €3,000 whose head office is located  at 14, bis rue des Temples 45240 La Ferté Saint Aubin and registered in Blois under the number 535 308 845, and any person or body, henceforth referred to as the "buyer", wishing to proceed with a purchase via Tragopan's company website.

Purpose

These terms and conditions aim to define the contractual relationship between the company Tragopan and the buyer as well as the conditions applicable to any sale completed via Tragopan's company website, whether the buyer be a consumer or a professional body. The purchase of a service through this website implies the full acceptance by the buyer of these terms and conditions. These terms and conditions supercede any other general or specific conditions not expressly agreed to by the company Tragopan. The company Tragopan has the right to modify its terms and conditions at any moment.  In this case, the terms and conditions applicable will be those effective on the date of order of the buyer.

Characteristics of the Goods Proposed

The products proposed are those which appear in the catalogue published on the website of the company Tragopan. These products are proposed within the limits of available stock. Every product is accompanied by a description carefully put together by the company Tragopan (or the supplier). The photographs in the catalogue are as realistic as possible but we cannot guarantee a total resemblance with the products offered, notably with regards to the colours.  As a consequence, the photographs are not contractually binding.

Prices

The prices displayed in the catalogue are in Euros and inclusive of VAT at the rate of VAT applicable on the day of order;  any change in the rate of VAT could have an effect on the prices of the products. The company Tragopan reserves the right to change its prices at any moment, although clearly the price displayed in the catalogue on the day of order will be the one applicable to the buyer. The prices indicated are exclusive of order processing, transport and delivery costs.

OrdersA buyer who wishes to purchase a product is required to:

• Fill in the personal identification form where all personal details are supplied
• Fill in the the order form on line providing all the information required
• Validate the order once it has been verified
• Make the payment under the conditions provided
• Confirm the order and the payment By confirming the order the buyer accepts the terms and conditions, perfectly understands them, and renounces his own terms and conditions or other conditions. The information provided together with the registration of the order act as proof of the transaction.  The confirmation has the effect of a signature and implies acceptance to carry out the transaction.  The seller will communicate confirmation of the order by email.

Returns

The Buyers, as non-professional individuals, have a legal delay of retraction of fourteen days with effect from the delivery of the order to return of the product to the seller for exchange or refund without penalty, with the exception of the return and shipment costs. The article must be intact, in its original packaging with labels, and must not have been used.  If the article returned does not meet these conditions, it will not be taken back or exchanged or refunded.  The company Tragopan promises to complete the refund in a maximum of 30 days.

Payment Methods

Payment is required at the time of ordering. Payments can be made by credit card, cheque or bank transfer.  Credit card payments are processed via the security system using the SSL "Secure Socket Layer" protocol so that all the information for the order and payment is encrypted by a software programme and no third party has access to it while it is transferred across the network. The buyer's account will not be debited until the day the order is posted. In case any of the articles ordered are no longer available, the customer will be immediately advised by electronic mail.  The buyer can then cancel or modify the order.   If the buyer chooses to modify the order, he or she will be charged the value of the new order.  If payment is made by cheque, this must be from a bank domiciled in France and payable in Euros.  For payments by bank transfer, any charges linked to the transaction must be totally at the customer's expense. A printed receipt including details of the VAT charged will be supplied with each order.

Customs duty and VAT 

For countries outside the European Union, the VAT does not apply to your order, the VAT will be paid directly to the customs of your country, which will contact you directly for payment and proceed to the delivery of your packages. 

Delivery

The goods are delivered to the address provided on the order form and can only be in the agreed geographic region.  The buyer is responsible for checking  the condition of the packaging of the goods and for reporting to the carrier any damage due on the delivery slip (packaging opened, packaging crushed, products missing, products damaged...) upon receipt.   The buyer must also inform the company Tragopan in no more than one week.  If no reservations are noted by the buyer on the delivery slip upon receipt of the package no claim will be taken into account.  For the deliveries, we work mainly with Colissimo Expert.  A message will be sent to you on the date of dispatch to confirm to you the delivery and the tracking number. The postal service commits to delivering any package in 48 hours.  However, it is possible, as in any delivery, that there may be a delay or that the package gets lost.  In case there is a delay in the delivery with respect to the date initially provided in the dispatch email, we would ask you to inform us by sending us an email.  We will then contact the postal service to initiate an investigation.  A postal investigation can last up to 21 days including the date of commencement of the investigation.  If, during this delay, the package is found, it will immediately be re-dispatched to your home address (the majority of cases).  If on the other hand the package is not found after 21 days of investigation, the postal service considers the package as lost.  It is only at this point that we can send you a replacement product at our cost.  If the product or products ordered are no longer available at this time, we would re-imburse you the value of your order including transport costs.  We do not accept any responsibility for longer delivery times, notably in the case of lost products, bad weather, or strikes.  Delivery timescales are only indicative:  if they exceed thirty days from the date of order, the sales contract can be cancelled and the buyer re-imbursed.

Guarantee

All articles are sold under the manufacturer's guarantee. They are guaranteed to be free from defects in workmanship or materials. Normal wear and tear, modifications by the buyer, inappropriate use, and damage caused by dropping the item or other shocks are excluded from this guarantee. The defective materials will be examined by the company Tragopan.  If the material is covered by the guarantee, the company Tragopan will replace it immediately by the same article (or by an article of the same value by agreement with the buyer if the article is no longer available). In every case we will do our best to reduce the delay to treat your case to a minimum.  Any materials replaced under guarantee will be returned to you free of charge.  Only the cost of sending the materials to us will be at your expense.

They are guaranteed 2 years. 

Responsibility

The seller, in the process of an on-line sale, is bound only by a best efforts undertaking:  he cannot be held liable for any damages resulting from the use of the internet such as data loss, hacking, viruses, service disruption or other unintended problems.

Intellectual Property

All elements of the website of the company Tragopan are and remain the exclusive intellectual property of the company Tragopan. No-one is allowed to reproduce, exploit, redistribute, or use for whatever reason, even partially, elements of this website whether software, visual or audio.

Personal Information

The information which is requested from the consumer is required for order processing. The company Tragopan is committed to never sharing the client information with any third party.  Furthermore, the user has the right to access and rectify any information concerning them, in accordance with the Act of the 6th January 1978.

Achival - Proof

The company Tragopan will archive all order forms and invoices on a reliable and durable medium which provides a true copy in compliance with the provisions of Article 1348 of the French Civil Code. The computerised databases of the company Tragopan shall be considered by the parties as proof of the communications, orders, payments and transactions exchanged between the parties.

Dispute Resolution

These online terms and conditions are governed by French law. In the case of a dispute, jurisdiction authority is assigned to the commercial court of the head office of the company Tragopan.
